1. Introduction
This is the privacy policy of Sacco Restaurants Inc. (“Epic Wings”). Epic Wings offers dining and carry-out foods featuring freshly-cooked, never frozen chicken wings, strips and other foods and beverages. Epic Wings is collectively referred to in this privacy policy as “we,” “us” or “our.”
This policy seeks to inform you of our policies and practices and choices you can make regarding personal information we have about you through our website and Android and iOS applications.
We try to respect your privacy. This is a policy, stating what we try to do. It is not a contract obligation on our part. However, pursuant to this policy you grant certain consents, licenses and exclusions and limitations of liability.
Please review this policy. If there is any part you do not agree with, or if you do not think this policy provides enough protection, this policy tells you how to let us know. You can also elect not to use our website and software applications. If there is any information you do not consent to our receipt, collection, use of or sharing, you can let us know and elect to opt-out. 2. Our Information Gathering Practices
We obtain information several ways. We try to limit the information we obtain to only what is necessary for the purposes identified below. Here are types of information we collect, and where it comes to us from.
Voluntary Disclosure. We collect information you provide, such as your name, address, phone number, and email address. We obtain this from you. We collect information we receive from your visit to our website or use of our managed pages in the site www.epicwings.com (the “Site”) or your use of our Android and iOS applications (the “Mobile Application”). When you visit or use the Site or Mobile Application, we obtain data about you, the device you use, your visit, date and time of visit, browser type, IP address, what you do in the visit, pages you visit, order of pages, time on each page, and other information. These are only examples; technology may let us collect and store other data about your visit, use and activities.
Account Information. When you sign up for our loyalty program, My Epic Rewards, on the Site or Mobile Application, we ask for personal information, such as your name, username, password, phone number, zip code, birthdate, email address and your favorite Epic Wings location.
Other Information. Other information we collect or develop from your visits to the Site and the Mobile Application, or from our system’s internal processes, could include alternative name(s) you use or have used; IP addresses connected to you; information on browsing, search, purchase and use histories and tendencies; website path-of-travel; location information; electronic information; transaction information, including information about the items you buy, product pricing you reviewed and paid for, method of payment and payment details; and other profile information.
Comments. You can email us through our Site or write to us. A link to our Site contact form and mailing addresses are provided at the end of this policy. Our personnel also receive emails. We
store these communications, including personal information you include, so we can respond or evaluate the comments in the future.
Other Information. Possibly we could collect other information not listed above, for example, metadata, and new kinds of information derived since this policy was written or will be derived in the future, that we collect or will collect. Personnel could receive information from sources not categorized above, such as being told information, seeing or hearing information on the internet or in other media, receiving unsolicited information, learning something in a discussion and noting it for reference, or any other ways information is received, noted and saved.
Other Sources. We collect any information you enter on the Site or Mobile Application, or that your device provides to the Site or Mobile Application, or that you or others give us in another way. Our Site and Mobile Application are not intended for individuals under the age of 13. Therefore, we do not knowingly collect personal information through our Site or Mobile Application from children under the age of 13. We use cookies to try to improve the quality of our service, make the Site and Mobile Application easier to use, and protect you and us. In the past 12 months we collected these kinds of personal information about consumers: names, alternative names used, IP address, email address, postal code, phone number, device used,
browser used, operating system, path of travel on our website, visitor geolocation, electronic information, and other kinds of information this policy describes as information we collect.
6. Sources of Information
As noted above, sources of information from which we collect personal information are persons who provide us information about themselves, those who submit comments to us, information you provide us in employment applications, and information the Site and Mobile Application collect from devices used to access the Site and Mobile Application. Other sources include information received in news and advertising media (broadcast, print, internet, social media) and information received in oral and written communications with others.
7. Purposes for Collecting and How We Use Your Information
Personal information. We use information you give us to provide you information on items we offer, promotions, ordering food online, and to enable you to participate in our My Epic Rewards loyalty program. We use your IP address to help identify you and gather information for statistical purposes.
Analyses. We use information about visits to the Site and Mobile Application to do statistical analyses of user behavior and characteristics and measure interest in and use of areas of the Site and Mobile Application, including the use of Google Analytics+ and Meta Pixel. We could in the future use the information in ways or do things we do not currently do or did not do when we obtained the information.

Previously Disclosed Information. If you previously disclosed information to us, we can transfer it to the Site and Mobile Application. We use this to register your use of the Site and Mobile Application. We use it for accuracy, to update our information on you.
Service Providers. We give third party service providers access to the information collected on you for web management, consulting, sending communications to you, service and repair of our technology equipment, and other usages in performing their services for us.
Administration. We use information collected for administrative purposes, such as investigating abuses, responding to inquiries, applying our policies or responding to inquiries and claims.
Investigation. We use or disclose information if we believe this is required or, even if not required, will satisfy a law, regulation or legal request, subpoena, court discovery requirement, to protect the integrity of our Site and Mobile Application, or cooperate with law enforcement, government or public safety or private investigations, or a demand or request of a tax authority, litigant or private party. We can cooperate with a request even if not legally required.
Aggregate Information. We use non-personal information to customize our content, try to improve our services, conduct research, and provide anonymous aggregated reporting for internal analysis, audits and third parties.
Merger or Acquisition. If we merge, acquire or are acquired, or explore doing so, other participant(s) in the transaction and their advisors will have access to information we have. The successor entity could have different policies, or could choose to modify these policies.
We do not knowingly sell, trade or transfer information to others outside the scope described above. But new ways of information gathering and sharing and new circumstances may occur. You should not take anything in this policy as assurance that information is not or will not be shared in other ways.
8. How Long We Keep Information
Unless a specific retention period is mandated or permitted under applicable law, we will only retain personal information for the duration of time necessary to fulfill the purposes described in this policy. We will retain and use your information to the extent necessary to manage your relationship with us, personalize and improve your overall customer experience, and to comply with our legal obligations (for example, if we are required to retain your information to comply with applicable tax/revenue laws), resolve disputes, enforce our agreements, and as otherwise described in this policy.

You can ask us to delete information about you. If you ask us to delete information about you, we will try to do that within 45 days after getting your instruction. However, we will keep your name, email address and postal code on a list to help us try to avoid again saving information about you and sending you marketing. 12. Choice/Opt-Out
You may ask not to receive communications, for us not to sell information about you, and/or remove information we have about you. You can ask us to block our system from receiving
information about you, or delete prior information regarding you, so that we begin anew as to information we then receive. To not receive marketing email communications, you can change your marketing email preferences by following the “manage your email preference” link at the bottom of our marketing emails. As a result of your request, we will still have some information about you, for example, our system keeps a record that you asked us to remove information and not send email or other correspondence to you. If we made and stored backup records, information about you will remain in those stored records.

We try to protect personal information. For example, the Site and Mobile Application have security measures to reduce risks of loss, misuse and alteration of information under our control. Our measures are updated and tested from time to time. We do not claim to have the most advanced or best possible or perfect security measures. No measures provide 100% certainty against all risks. Inadvertent disclosure, technology changes, hackers, dishonesty by persons with access, human error and weaknesses in procedures are examples why it is impossible for us, or anyone, to guarantee your information cannot be accessed or disclosed. We do not sell your personal information, in the ordinary sense of selling names and addresses to others unrelated to us for money so they can advertise or solicit you to buy goods or services.

16. California Residents Privacy Rights

This policy also provides you certain controls and choices regarding our collection, use, and sharing of your information.
California Civil Code Sections §1798.100 and §1798.105 let a California resident make requests to access categories and items of personal information about you, and request deletion of personal information about you. You may make such requests up to two times in any twelve (12) months.
If you are a California resident, California Civil Code Section §1798.83 lets you request information regarding disclosure of your personal information by us to third parties for the third parties’ direct marketing purposes.

18. Exercise by Your Representative
Rights described in this policy that you may exercise, may also be exercised by your authorized representative. We require proof that the representative is authorized by you. We anticipate that we will accept a form of authorization or permission provided and signed by the consumer authorizing the representative to act, together with verification of the consumer’s identity or other direct confirmation from the consumer of having authorized the representative to act. Alternatively, we can accept a signed, notarized power of attorney appointing the representative.
